Terms of sale
Version 2026-10-23 ·
In short
- You buy from Ayin, which is Eliyahu Moshe Leinkram, ABN 98 293 572 810. An independent jeweller, named on your order, makes your piece.
- For now Ayin sells in Australia only. A piece of A$5,000 or less is sent insured, signed for at your door; a piece over A$5,000 is collected from your jeweller’s workshop, with photo ID. Anyone, anywhere, can design and save.
- If anything’s wrong, we’ll make it right. A piece that arrives damaged or not as designed is refunded in full; a making fault is repaired, remade or refunded for 12 months; and if you change your mind, we remake it once into a new design.
- Your measurements and ring size are yours to get right, and the words and pictures you use must be yours to use.
- The pictures are renders, the AI’s suggestions are not professional advice, and a price is fixed once you have paid.
- Prices are in Australian dollars and include GST, and insured delivery for every piece that is sent: one total, the price you pay. Every sale comes with a tax invoice. Delivery dates are estimates.
- Nothing here takes away your rights under the Australian Consumer Law.
- Write to concierge@fromayin.com first. New South Wales law applies.
The full terms
1. Who’s who
These terms are between you and Eliyahu Moshe Leinkram, ABN 98 293 572 810, of Sydney, New South Wales, Australia (“Ayin”, “we”, “us”). Ayin sells you your piece, and Ayin is who you deal with, from your first word to its delivery.
Each piece is made by an independent jeweller in Australia, named on your order before you pay. The jeweller is not Ayin’s employee, partner or agent, and cannot make promises for Ayin. Ayin buys the piece from the jeweller and sells it to you.
For now, Ayin sells only to customers in Australia, for delivery to (or collection at) an address in Australia. Anyone can design and save a piece on Ayin from anywhere, and leave an email for when Ayin opens in their country.
Ayin is registered for GST, under ABN 98 293 572 810.
You must be 18 or older to place an order.
2. Using Ayin
Designing on Ayin is free. Please use it fairly: nothing unlawful, and no attempt to break, overload or copy the site. We may limit or stop use that breaks these terms.
How we handle your information is in our Privacy policy.
3. Made to order
Every piece is made to your own design, after you order it, for you alone. So we don’t refund a change of mind; instead, our promise remakes your piece once into a new design (below).
When you pay by card, your card is held, not charged. Your order is accepted when the maker you chose accepts it, within 24 hours, and only then is your card charged. If they can’t take it on, we ask you what happens next: another maker, or a full refund. Nothing changes without your yes. If no maker accepts it, the hold is released in full and there is no sale.
When you pay by bank (PayTo), the payment is taken at once, and Ayin holds it until the maker you chose accepts. If no maker says yes, it is refunded to you in full, automatically, and there is no sale.
You can cancel for free until your jeweller accepts. Once making has begun the piece is yours alone, and it cannot be cancelled for a refund except under our promise, after a stone search (below), or under the law.
4. Approving your stone
For some stones, your jeweller finds the stone after accepting your order and shows it to you before anything is made: larger diamonds and natural gemstones, and one-of-a-kind stones such as opal or pearl. You see photos, a short video and its lab report when it has one, and the stone is never smaller or of a lower grade than your order.
You approve it, or ask for another of the same specification. If we don’t hear from you within 48 hours, it counts as approved. Asking for another is free twice; each one moves your date by a few days, and we tell you the new date.
After the second one, you can choose any of the stones you have been shown, upgrade to a different grade at a new price, or cancel your order. If you cancel then, you are refunded in full less a stone-search fee of A$150, GST included, which pays your jeweller for finding and holding the stones.
Once a stone is approved and set, it is final. Changing your mind about it after delivery is a change of mind: your one remake keeps the stone.
5. What “as designed” means
As designed means the metal, the stones, the size and the weight on your order, within these tolerances: 0.5 mm either way on any measurement, 5% either way in weight, and the ring size you chose.
The pictures you see are computer renders. Natural variation in stones (their colour, clarity and pattern), in the colour and finish of metal, and differences within the tolerances above are not defects, and do not make a piece not as designed.
6. Your own input
You are responsible for the measurements and ring size you give us. A piece made to the size you ordered is as designed, even if it does not fit; resizing is included in your one remake (below).
You must have the right to use any words, pictures, photographs or logos you give us, and by giving them you confirm that you do. You allow Ayin and your jeweller to use them only to design, make and deliver your piece.
We may refuse a design, or cancel its order with a full refund, if it copies another brand’s protected design or logo, or is unlawful or hateful.
Before your order goes to a jeweller, we may check it for another brand’s name, mark or logo, or a character or artwork that belongs to someone else. If we need to look more closely, your order waits until we have, and you can still change your piece, or cancel it for free.
Your design is yours. Neither Ayin nor your jeweller sells copies of it to anyone else, and we show your piece publicly only with your permission.
7. Our promise to you
If anything’s wrong, we’ll make it right. If your piece arrives damaged or not as you designed it, tell us within 14 days and we’ll refund you in full. If anything fails because of how it was made, within 12 months, we’ll repair or remake it free, or refund you if it can’t be fixed.
Changed your mind? We’ll remake it. Every piece is made just for you, so we don’t refund a change of mind. Instead, within 30 days of delivery, we’ll remake your piece once into a new design, using the same gold and stones. Resizing is included.
Your rights:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
How to ask: Email concierge@fromayin.com with your order number and a photo. We’ll arrange everything, including insured return postage, at our cost.
8. Remaking your piece
When you change your mind, we remake your piece once into a new design. So that it can be made from what you already have:
- the new design uses the same stones, and no more metal than the original, less a small allowance for the metal lost in casting;
- a small top-up of metal is allowed for resizing;
- your jeweller replaces any tiny accent stones lost in the remake;
- the remake is made once, within 30 days of delivery, and we arrange the insured postage both ways at our cost (a collected piece is handed back, and collected again, at your jeweller’s workshop).
We check the new design against these rules with you before it is made.
9. The 12-month warranty, and what it does not cover
A making fault is a failure because of how your piece was made: a stone that loosens in normal wear, a joint or clasp that fails, a finish that was not as ordered. For 12 months from delivery we repair or remake it free, or refund you if it can’t be fixed.
The warranty does not cover:
- normal wear, such as scratches and the slow wearing of metal over time;
- accidents and misuse, such as a knock that bends a claw, crushing, or harsh chemicals;
- work by someone else: a piece resized, repaired or altered by anyone other than your jeweller through Ayin;
- natural variation in stones and metal, and differences within the tolerances above;
- a piece made to the size or measurements you gave us (resizing is included in your one remake);
- a characteristic of a material that its care note described before you paid, and that you ticked as read: for example plating that softens with wear, or a stone that scratches more easily than diamond;
- rhodium plating on white gold wearing thin, and silver tarnishing: both are normal wear;
- damage to a soft stone, such as opal, pearl or turquoise, from a knock or from chemicals, when its care note was given before you paid.
Under the Australian Consumer Law, goods are not of unacceptable quality only because of something that was specifically drawn to your attention before you agreed to buy them, or because of damage from abnormal use. That is why each care note is shown before you pay, and why we keep what you ticked. A care note never excuses poor workmanship: a stone that was badly set is still covered, whatever its note said.
To claim, email us with your order number and a photo, as above. We pay the costs of a claim, including insured return postage (a collected piece is handed back at your jeweller’s workshop instead). The warranty is given by Ayin, named below. The benefits to you given by this warranty are in addition to your other rights and remedies under a law in relation to the goods to which the warranty relates.
10. Who gives the promise
- Name: Eliyahu Moshe Leinkram, ABN 98 293 572 810.
- Where: Sydney, New South Wales, Australia.
- Email: concierge@fromayin.com.
11. AI and prices
Ayin uses AI to turn your words and pictures into a design and to suggest changes. Its suggestions, previews and measurements help you design. They are not professional advice, for example about stones, value, fit or allergies.
Prices change as you change the piece, and as costs change. A price is fixed only once it is paid: the price on your order is the price you pay. Prices are in Australian dollars and include GST, and insured delivery for every piece that is sent: one total, the price you pay. Every sale comes with a tax invoice.
Nothing is added at checkout. Your tax invoice gives the seller’s name and ABN, the date, what you bought and the GST in the price.
On an order over A$1,000, paying by bank takes 1.5% off the price. It is a discount for paying by bank, never a surcharge on a card: the price shown is the card price.
If we make an obvious mistake in a price or a description, we tell you before your jeweller begins, and you may cancel for a full refund.
12. Delivery
Delivery dates are estimates: your jeweller’s making time, then delivery. Your order page shows where your piece is. A piece of A$5,000 or less goes anywhere in Australia by Express Post, insured with Extra Cover and signed for at your door. A piece over A$5,000 is collected from your jeweller’s workshop, by you or someone you name, with photo ID.
We tell you before you pay if your piece is to be collected. It is handed over at your jeweller’s workshop, to you or to someone you name, with photo ID checked against the order, and your order page says when it is ready. For a collected piece, “delivery” in these terms and in our promise means the day it is collected, and that is when it “arrives”.
Please check your address at checkout; we send your piece to the address you give.
The risk of loss or damage passes to you on delivery, or when the piece is collected. Until then, a piece lost or damaged on its way is ours to put right.
13. Limits
To the extent the law allows:
- Ayin’s total liability to you for an order is limited to the price you paid for it;
- Ayin is not liable for indirect or consequential loss, such as lost profits or opportunities; and
- Ayin is not liable for delays or failures caused by things beyond its reasonable control, such as natural disasters, strikes, carrier delays, epidemics, war, government action or outages (force majeure).
None of this limits what the law says cannot be limited (the next clause).
14. The law that can’t be excluded
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law that cannot be excluded.
15. Disputes
If something is wrong, write to concierge@fromayin.com first, with your order number. A person reads every message, and we work with you and your jeweller to put it right. Please write to us before disputing a charge with your bank.
These terms are governed by the law of New South Wales, Australia, and its courts can hear any dispute.
16. These terms
This is version 2026-10-23. The version in force when you pay is the one that applies to your order. We may update these terms; an update applies only to orders placed after it.
If any part of these terms cannot be enforced, the rest still applies.
